Μια πρώτη γέυση απο το Master Plan

Ένα από τα πρόσφατα παραδείγματα μη αναστρέψιμης καταστροφής του τοπίου στην ακόμα παρθένα παραλία του Περίβολου. Το παρακάτω κτίριο έχει εγκριθεί με άδεια οικοδομής από τον πρώην δήμαρχο Χιμάρας, Βασίλη Μπολάνο. Ο επενδυτής έχει αρχίσει παράνομα τις οικοδομικές εργασίες, μεταμορφώνοντας τη μορφή του βράχου και στρώνοντας μπετονένιες πλατφόρμες, έξω από τα όρια του εγκεκριμένου σχεδίου.
Όπως φαίνεται καθαρά στις φωτογραφίες το οικόπεδο βρίσκεται πραγματικά πάνω στην παραλία και μέρος του βράχου έχει καθαιρεθεί για να προσαρμοστεί με τις ανάγκες της οικοδομικής αδείας. 
Αυτό που παρουσιάζει ενδιαφέρον είναι οι νεο-φυτεμένες ελιές για να αποδείξουν την παρούσα χρήση γης του οικοπέδου.
Και το καλύτερο για το τέλος, η άδεια έχει εγκριθεί (για τουριστικές βίλες) με μια πολεοδομική μελέτη που δείχνει ως κύρια πρόσβαση δρόμο που εμφανίζεται εκεί που τώρα βρίσκεται η άμμος της παραλίας.


Αυτή είναι η Αλβανική ριβιέρα στην οποία έχουμε εναποθέσει όλες τις ελπίδες για έσοδα από τον τουρισμό 
κάτω από την μάσκα της ανανεώσιμης ανάπτυξης. Οι Αλβανοί αυτή τη στιγμή πενθούν το Δυρράχιο, τους Αγίους Σαράντα και τον Αυλώνα, αλλά πως θα εξηγήσουμε στα παιδιά μας ότι αφήσαμε να συμβεί αυτό εν έτει 2011 (για λίγα χρήματα?) Καλούμε όλες τις περβαλλοντικές οργανώσεις και τους πολίτες να λάβουν δράση πρωτού είναι πολύ αργά.






Σίγουρα θα τον θυμόμαστε για πάντα..όλοι λιγο πολύ έχουμε βγάλει φωτογραφίες σε αυτόν τον παράδεισο,με την χαρακτηριστική τρύπα...που οδηγεί σε μία ονειρική παραλία.

Όπως και να εχεί ντροπή στον Kill Bill..

Having taken part in a Himara Municipality Meetings of Council, two major associations, "Coast Association, and Himara Community", in an open letter to members of the Council, expressed criticisms and calling Municipality of Himara administration, closely cooperate with civil society of Diaspora and interest groups, to finally resolve the issue of ownership, as a negative factor, which brings division and disharmony historical Himara of the 26 century Independence.

Civil society, called the Himara member of Council, to unite, in a position, to receive an answer, in a period of three months, to the Albanian government and parliament, to decide finally legally, to resolve the property of residents, community and the Orthodox Church, in Himara Region.

            Την Κυριακή 11 Δεκεμβρίου έγιναν οι εκλογές για την ανάδειξη του νέου ενδεκαμελούς Διοικητικού συμβουλίου της ένωσης Χειμαρριωτών. Η παρουσία του κόσμου στον προκαθορισμένο χώρο των γραφείων της ΕΣΗΕΑ ήταν αρκετά ικανοποιητική. Το Δ.Σ που προέκυψε στις 11 του Δεκέμβρη συγκροτήθηκε σε σώμα στην 1η συνεδρίασή του στις 15-12-2011 με την παρακάτω σύνθεση:

The Himara NGO`s ready to protest for return the all properties



Himara NGOs of the region, warning to the Municipality of Himara, to interrupt the relationship, if the Project Plan for Development of the Region, will be approved without returned total properties to the successors residents of The Himara Region .

Meanwhile NGOs of Himara, calling on the Albanian government, to implement 12 points of the EU requirements, especially for the return of property.

Himara NGOs of the Region, "the Association Coast", "The Himara Community", "the Association of Tourism", and " The Association of Businessmen", placed on Monday, to consider the final decision-making of the Himara Municipality, as contrary the interest of the Himara Region, warning, for interruption of relationship with the local administration, and to define a new strategy, created in relations with the Albanian state, especially not to return under the Constitution, community property, including the properties of the Orthodox Church.

Himara NGOs of the Region, also call the American Embassy, as the funding of many projects to the Himara Municipality, follow with deep concern, recent decisions of The Municipality Council, particularly the approval of the Area Development Plan, without turning , in collaboration with the Albanian government, all properties, of auttokton community.


Thousands of American and European descent from the Region of Himara, expected to join a new decision, of the NGOs, to be sent a critical note, to the Albanian government, which has obligations determined by international agreements, especially with EU and USA , to return totally, the Himara community property.

Himara, US Embassy supports cultural promotion
Professors, citizen and Municipality employees participated at the international conference in Himara, with the topic “26 centuries of history”.

Himara is one of Albania’s regions with the highest tourism and cultural potentials, which must be exploited in the best possible way for helping economy. The US Embassy has financed this project through small grants from the Commission for Democracy.

The Public Relations Director of the US Embassy in Tirana, Elisabeth Lewis, spoke in Albanian and declared that it is very important to cooperate with the civil society and local or central representatives.

“This project is a very good example of how the civil society and local government could cooperate. We expect more cooperation in the next years to come, for strengthening the democratic capacities and for increasing the trust between civil organizations and their partners in government and private sectors”, Lewis declared.

The Coastline Association realized this project that aims to highlight Himiara’s historical and cultural values, and the high potentials of tourism development in this geographically important area of our country.

The process of registration of agricultural lands, pastures and forests in the Albanian coast has been suspended. A decision of the Municipal Council of Himare, sparks controversy on matters of lands in the region of Himara

Himara non-governmental organizations, see the decision, of the new Land Registration Law 7501, as an order to facilitate the Albanian Mafia, which cares for the looting of the lands in the region of Himara

On 21 October, the Municipality Council of Himara , took place for the Albanian government asked them, setting up land distribution committees, with the 7501 law, in contrast to full property restitution efforts of Himara population, turning once again, the chance to lose opportunities to resolve the land in the region.

This decision was opposed by all non-governmental associations Himara that the next days, will intensify their efforts to stop the implementation of Law 7501, the Region of Himara and Lukovo.

In this plan, the Albanian government has proposed a law, in which, claims commissions organize the division of land in those regions as Himara, including the 7501 law, and not according to the inherited property.

Also, strangely, the municipal council of Himara, adopted the Master Plan priorities and registration of properties, which are blocked by the OSCE, until a legal and fair solution to the question of ownership.

According to the last electoral municipal campaign, all the candidates, including ex Mayor Vassil Bollano and actually in Head Jorgo Goro, supported the registration process under the Law 7501, as all programs of Albanian Parties in controversy of the rights of the people of Himara.

After several
years of interruption, resumed activity of The "Himarrioton Society of America", which will be under the direction of well-known father Kosmas Karavellas Annapolis. The group organizer, in the presence of about 100 participants, presented the program of the Association, which will seek to achieve goals inherited from the founders in the early 20th century in USA.

The "Himarrioton Society of America", will make every effort to invoke the voice of the World personalities by Himara Region origin, such as "Cultural Ambassador of Himara in World", George Tenet and Olympic Weightlifting champion Pyrros Dhimas, also honorary member of The Himara Community of Albania.

Also, The "Himarrioton Society of America" would like to organize meetings in US Congress and Senate, to claim historical rights to Himara Region, by lobbying to the U.S. Department of State.

Further it under the program, the three associations of Himara in World, USA, Albania and Greece, will organize next year, to be called Pan Himariot Congress in Himara Town, with the participation of personalities throughout by the Diaspora.

OSCE blocks the registration of property in Himara Region

Në emër të kryesisë së shoqatës “Bregdeti” shprehim respekt për institucionin që përfaqësoni. Ju drejtojmë këtë letër publike pasi jemi të shqetësuar se në zonat turistike akoma nuk ka përfunduar kthimi fizik i pronës tek pronari i ligjshëm. Nisur nga fakti se Kryetarja e Kuvendit kërkoi bashkëpunimin e opozitës në Kuvend dhe se futja e Shqipërisë në BE është çështje kombëtare dhe se një ndër 12 kërkesat e BE për politikën shqiptare është zgjidhja e problemit të pronës ju parashtrojmë sa vijon:

Pronarët autoktonë të zonës turistike të bregdetit, kërkojnë atë që është më themelore për një vend të shpallur demokratik: zbatimin e Kushtetutës dhe të Kodit Civil, për kthimin tek i zoti të pronës që ka shtetëzuar shteti i diktaturës. Situata e përgjithshme e mos respektimit të së drejtës së pronës është po ajo që ju kemi paraqitur me dhjetëra kërkesa tona të mëparshme, por kalimi i kohës po e rëndon situatën. Mafia dhe korrupsioni që ka prekur politikanët i imponon ata të flasin për probleme të tjera duke e spostuar problemin e pronës. Nuk mund të ketë pranim të Shqipërisë si vend kandidat në BE me pronarë false, të krijuar nga politika. Këtë e kanë bërë të qartë shumë përgjigje që na kanë ardhur nga drejtuesit e BE dhe KE si dhe disa rezoluta të Senatit Amerikan. Qeveria Shqiptare me vendimin Nr.350, datë 29.4.2011, ka miratuar “Planveprimin për zgjidhjen e problematikës së çështjeve të pronësisë …”, që i është raportuar KE. Ky planveprim është i gabuar dhe ka për të dështuar sepse problematikën e pronës nuk e zgjidh kompensimi por kthimi fizik. Zgjidhja e qëndrueshme kërkon zbatimin e parimeve duke zbatuar Kushtetutën, duke shpallur të pavlefshme vjedhjet dhe transferimet e pronave që janë bërë në kundërshtim me përmbajtjen e nenit 181 të Kushtetutës dhe të Konventës. Kompensimi siç pretendon Qeveria, bie ndesh me nenin 41 të Kushtetutës, pasi nuk mund të justifikohet si nevojë publike që pronat tona me vlera turistike ti gëzojnë politikanët e pas vitit 1991 dhe klanet e tyre. Kompensimi që preferon Qeveria, jo vetëm që bie ndesh me Kushtetutën, por duke kompensuar vetëm nga 200 metra katrore ky proces nuk përfundon as pas 700 vjetësh. Veç kësaj kjo Qeveri nuk mund të lërë detyra për qeveritë e tjera. Ne sugjerojmë që ky kompensim t’u jepet atyre që kanë përfituar padrejtësisht pronat tona që do të iu hiqen dhe problematika me pronat në zonat turistike të zgjidhet duke respektuar të drejtën e pronësisë duke e kthyer pronën e grabitur tek i zoti sipas nenit 181 të Kushtetutës, Kodit të Procedurës Administrative dhe Kodit Civil. Ligji famëkeq 7501, që është burim korrupsioni dhe të këqijash. Ky ligj deri sot, për interesat e klaneve, është amenduar mbi 20 herë, por duke ruajtur të pa prekur nenin 8 që thotë se ...” Komisionet ndajnë tokë pa marrë në konsideratë sasinë dhe vendin e tokës që është shtetëzuar...” Përgjegjësi për këtë nen diabolik, kanë politikanë shqiptarë por dhe OSBE, sepse ajo kishte tagrin nga Evropa për hartimin e ligjit të ri në vitin 2003 dhe e lejoi të mbijetojë këtë nen gjatë hartimit të ligjit 9235, që u miratua në vitin 2004. Sugjerimet dhe ankesat e pronarëve që janë pala e interesuar që vazhdon të grabitet, nuk u morën në konsideratë. Që Shqipëria të pranohet në Evropë është e domosdoshme të bëhet konsensusi Berisha-Rama që ligji 7501, të amendohet edhe një herë në mënyrë që neni 8 i tij të përputhet me nenin 181 të Kushtetutës në fuqi dhe me kërkesat e BE. Kjo do të bëjë të mundur që tensionet e krijuara të mos rriten më tej, që të mos nxitet vetëgjyqësia, që procesi të futet në rrugën e zgjidhjes dhe reforma e pronës të kryhen në përputhje me kërkesat e nenit 181 të Kushtetutës, me rekomandimet e dokumentit nr 11115 datë 20.12.2006 të Asamblesë Parlamentare të Këshillit të Evropës pikat 9.6 dhe 191, që nuk po zbatohen.

Në planin konkret ne sugjerojmë që me procedurë të shpejtuar të hartohet një ligj ku të realizohen këto kërkesa:

-Zgjidhja e problemit të pranohet me ligj si detyrimi i qeverise dhe shtetit. Ky proces duhet të ndahet në dy faza dhe me dy ligje të veçanta: kthimi dhe fill pas përfundimit të kthimit të vazhdojë kompensimi.

- Ligji të përcaktojë se termi ish pronar i përdorur deri sot të zëvendësohet me termin trashëgimtar i pronarit të ligjshëm.

- Nga Shteti të studiohet kodi i tokës dhe regjistrat e shtetëzimeve si dhe të bëhet harta e pronave të shtetit.

- Qeveria të bëjë korrigjimet e gabimeve në reformën e pronave. Kjo të fillojë me prioritet nga zonat turistike, pasi ajo është më problematike.

- Parlamenti të shpalli të ngrira ligjet ekzistuese, për kompensimin dhe legalizimet në zonat turistike, ndërkohë Qeveria të hapi arkivat kadastrat, hipotekat, regjistrat e shtetëzimeve dhe nëpërmjet dokumenteve , të ndajë dhe dallojë se cilat janë prona të shtetit (ku shteti gëzon ligjërisht titujt e saktë të pronësisë) dhe cilat janë prona që Shteti i diktaturës ju grabiti pronarëve të ligjshëm. Për pronat që janë shtetëzuar d.m.th. të marra padrejtësisht nga shteti i diktaturës, vetë Shteti me levat dhe institucionet shtetërore, të korrigjojë gabimet e tij, nëpërmjet kthimit.

- Ligji të përcaktojë një afat kohor për kthimin fizik të pronave të trashëguara, në kufijtë e tyre sipas dokumenteve zyrtare të para vitit 1945, dhe dokumenteve të shtetëzimeve, që shteti i disponon në Arkivat shtetërore, duke i rikthyer të drejtën e pronësisë dhe të posedimit pronarit të ligjshëm. E drejta e përdorimit mund t’i mbetet përsëri personave të tretë dhe marrëdhëniet pronar/përdorues rregullohen sipas Kodit Civil dhe ligjeve ekzistuese në fuqi.

- Ligji të përcaktojë se nga pronat e shtetëzuara nuk kthehen tek i zoti por kompensohen ato prona që janë tjetërsuar për ndërtime banimi para vitit 1991, prona që vazhdojnë edhe sot të shfrytëzohen për nevoja publike konform ligjit dhe ato prona , që për shkak të kohës që ka kaluar dhe shfrytëzimit janë amortizuar, nuk ekzistojnë më dhe nuk mund të kthehen.

- Kompensim mund të parashikohet rast pas rasti me kompensim ose edhe masë zhdëmtimi ndaj personave të tretë, që për këtë periudhë tranzicioni të postkomunizmit i kanë përfituar dhe po i shfrytëzojnë pronat e pronarëve.

- Pronarëve të ligjshëm t’u kthehet plotësisht prona dhe e drejta e parablerjes së objekteve të ngritura mbi tokat e tyre dhe të privatizuara dhe në kundërshtim me ligjet e kohës, duke shpallur kështu të pavlefshme tjetërsimet që bien ndesh me të drejtën e pronësisë të përcaktuar në nenin 181 të Kushtetutës. Personave që ju hiqet prona të trajtohen rast pas rasti sipas parimeve në pikën 8 më sipër.

- Ligji që do hartohet të ngarkojë organin shtetëror të Avokatit të Shtetit ose Kontrollin e Shtetit që nëpërmjet proceseve gjyqësore të shpallen të pavlefshme ato pjesë të vendimeve me të cilat pas vitit 1991, organet shtetërore nuk kanë kthyer pronën tek trungu familjar i pronarit të shpronësuar por e kanë transferuar pronën e subjekteve të shpronësuar në persona të tretë.

-Kthimi fizik i pronës të bëhet në bazë të dokumenteve të para kolektivizimit komunist dhe jo sipas zërit kadastral apo llojit të pronës (tokë bujqësore, kullotë, livadh, truall, pyll etj.)
