The land in Himara belongs to the people of Himara! Land and property registration NOW!

Ky eshte peticioni i popullit te Himares te cilit po i mohoen te drejtat e tij kushtetuese mbi pronen.

E drejta e prona perben nje te drejte kushtetuese sic percaktohet ne nenin 41 e 42 te Kushtetutes se Shqiperise.

Ne mbare Bregdetin Jonian tokat kane qene prone e familjeve vendase, e kishave ose e mbare fshatit. Nuk ka pase cifligare a bejlere as prona te shtetit.

Qe prej vitit 1956, me heqjen e pronesise mbi token nga sistemi komunist i kooperativave bujqesore, populli i Himares nuk gezon tituj pronesie per token bujqesore, truallin, shtepine dhe bizneset dhe as per pronat komunale si kullota, pyje e plazhe.

Ne vitit 1991 u votua ligji i shumekontestuar 7501 "Per token bujqesore". Megjithese ky ligj nuk mund te implementohej ne krahinen e himares per shkat te specifikave te pronesise mbi token, u be ndarja e tokes bujqesore edhe ne krahinen e Himares duke mohuar te drejten e trashigimise se prones.

Qe prej viti 2007, eshte ndaluar cdo rregjistrim i pronave ne krahinen e Himare me nje urdher te brendshem te qeverise i cili ndalon rregjistrimin e pronave ne favor te popullit Himariot edhe nese ka nje vendim gjykate qe e detyron rregjistrimin.

Siperfaqe te medha tokash ne pronesi te Kishes ose bashkise rezultojne te lira pasi ato nuk jane rregjistruar ne rregjistrin e pasurive te paluajtshme dhe si te tilla qeveria ja ka kaluar fondit te tokave qe do te perdoren per kompesimin e ish-pranareve te shpronesuar gjate komunizmit ne Tirana, Fier, Berat e krahina te tjera te Shqiperise.

Pronat e kishes dhe pronat komune perbejne element perfaqesues te komunitetit Himariot i njohur per karakteristikat e tij etnike e fetare. Tjetersimi i ketyre pronave per llogari te shtetasve qe nuk jane banor te Himares do te krijoj konflikte te cilat mund te kene pasoja per stabilitetin etnik e fetar ne krahinen e Himare.

Cuditerishte gjate gjithe kesaj periudhe, individ, grupe dhe subjekte me influece ne politike perfshire dhe kapitale me origjine veprimtarie kriminale kane pervetesuar ne menyre te paligjshme siperfaqe te medha tokash nga prona private, prona e kishes e prona komunale dhe kane aritur ti rregjistrojne  ne ZRRPP duke anashkaluar jo vetem ligjin por dhe pengesat qe hasin Himariotet per rregjistrimin e pronave te tyre ne ZRPP.

Cdo dite qe kalon, me mijra Himariot nuk mund te trashegojne pronat e prinderve te tyre sepse ato nuk jane te rregjistruara.

Himariotet te cilet ndertojne shtepi apo biznese ne tokat e tyre, ndeshkohen me prishje masive te objekteve te tyre nga Policia Ndertimore sepse nuk mund te nxjerin leje ndertimi pasi nuk kane aktin e pronesise mbi token te cilen e posedojne ligjerishte.

Bashkimi Evropian ka financuar nje projekt per rregjistrimin e pronave ne krahinen e Himares i cili ne vitin 2011 filloi regjistrimin ne terren te trojeve dhe shtepive nen mbikqyrjen e misionit te OSCE ne Shqiperi. Por ky projekt, megjithese perfundoi fazen kryesore te rregjistrimit te pronave ne teren, nuk u finalizua per shkak te mangesive dhe handikapit te legjislacionit te pronesise te cilat ben qe procesi te deshtoj.

Nese dhe TI mendon se kjo padrejtesi qe po i behet popullit Himariot duhet te ndaloj,

Nese mendon se ka ardhur koha qe populli Himariot duhet te gezoj te drejten e tij Kushtetuese te prones e cila po i mohet prej mbi 50 vjetesh.

Nese mendon se Shteti Shqiptar ka detyrimin te njohe si pronar te ligjshem te Himares popullin Himariot kudo qe ndodhet ne Shqiperi ose ne emigracion ne Greqi, ne Angli, Ne Gjermani ose ne USA, e kudo.

Me respekt dhe besim ne parimet demokratike qe udheheqin Keshillin e Evropes si perfaqesues i parimeve dhe idealeve te Popujve te Evropes dhe te vetedijshem per fuqine e ketij Instuticioni.

Firmos tani kete peticion drejtuar Keshillit te Evropes, per rregjistrimin e pronave te Himares ne emer te pronarit te vetem te ligjshem: POPULLIT TE HIMARES.

This is the petition of the people of Himara which is beeing denied his constitutional rights on property.

The right of property constitutes a constitutional right as defined in section 41 of the 42 of the Constitution.

Across the Ionian coast, land was owned by local families, the orthodox churche or the community. There were no big landlords and neither state properties in this area.

Since 1956, with the abolition of land ownership by the communist agricultural cooperative's system, the people of Himara do not enjoy property ownership titles of agricultural land, homes and businesses and even on municipal property such as pastures, forests and beaches.

In 1991 when the contestet 7501 law "About the farming land" was voted in the parliament, although it could not be implemented in Himara region due to its special relations of land-ownership, agricultural lands was redrawn in the region of Himara denying the right of inheritance of property.

Since 2007, any registration of properties in the region of Himara is banned with a government internal order which prohibits the registration of the property in favour of the people of Himara even if there is a court order that compels registration.

Large areas of land owned by the church or by the community are declared free of ownership as they are not registered in the register of real estate and as such they have passed to the land fund to be used for compensation of former owners expropriated during the communism in Tirana, Fier, Berat and other regions of Albania.

The properties of the orthodox church and the community represents important elements of the Himariot community known for its ethnic and religious characteristics. Alienation of these properties on behalf of citizens who are not resident of Himara will create conflicts which will have consequences in the ethnic and religious stability in the region of Himara.

During all this period individuals , groups and entities with political influences and with capitals sometimes comming of criminal activity or unknown origin have ilegaly taken possesion of land which belong to private owners, the church or the community and they have registered this properties bypassing the law and the obstacles which Himara's people cannot overcome when trying to register their legaly owned properties.

Every day that passes, thousands of Himariots cannot inherit their parents' property because these properties are not registered.

Inhabitants of Himara that did build homes or businesses in their property, are being punished with massive destruction of their buildings by the Construction Police because they could not issue any building permit since they don’t have the act of ownership of the land which they own since generations.

The European Union has funded a project for the registration of property in the region of Himara which in 2011 began registering of land and houses under the supervision of the OSCE mission in Albania. But this project, although the first phase of the recording of properties was completed, it was not finalized due to disabilities and gaps in the legislation regarding ownership which forced the process to fail.

If you think that this injustice, done to the people of Himara should stop,

If you think it is time that the people Himara should enjoy theur constitutional right to property which is been denied to them since over 50 years.

If you think that the Albanian government has the obligation to recognize as lawful owner of Himara, the people of Himara, wherever they live in Albania, in Greece, in England, in Germany, in USA, ect:

With respect and faith in the democratic principles governing the Council of Europe as a representative of this principles and ideals of the peoples of Europe and aware of the power of this Institution:

Signe now this petition to the European Councile, for the registration of properties  to the only and single eligible owner: the PEOPLE of Himara.

Αυτό είναι το ψήφισμα των Χιμαραίων στους οποίους αρνούνται το συνταγματικό δικαίωμα στην ιδιοκτησία.

Το δικαίωμα στην ιδιοκτησία αποτελεί συνταγματικό δικαίωμα όπως ορίζεται στα άρθρα 41 και 42 του Συντάγματος της Αλβανίας.

Κατά μήκος της Ιόνιας ακτής η γη ανήκε παραδοσιακά στις ντόπιες οικογένειες, στην Ορθόδοξη Εκκλησία και στις τοπικές κοινότητες. Δεν υπήρχαν μεγάλοι γαιοκτήμονες καθώς και κρατικές γαίες σε αυτή την περιοχή.

Από το 1956, με την κατάργηση της εγγείου ιδιοκτησίας από το κομουνιστικό καθεστώς και την αντικατάστασή της από το κομουνιστικό σύστημα αγροτικής κοινοκτημοσύνης, οι Χιμαραίοι στερούνται τίτλων ιδιοκτησίας των αγροτικών γαιών, των σπιτιών και των επιχειρήσεών τους ενώ και οι κοινότητες δεν έχουν τίτλους για τη δημοτική περιουσία (βοσκοτόπια, δάση, παραλίες).

Το 1991, όταν ψηφίστηκε από το αλβανικό Κοινοβούλιο ο νόμος 7501 «Περί αγροτεμαχίων», παρότι δεν μπορούσε να εφαρμοστεί στην περιοχή της Χιμάρας εξαιτίας των ειδικών συνθηκών ιδιοκτησίας, ξαναμοιράστηκαν αγροτικές γαίες και στην περιοχή αυτή, στερώντας, όμως, το δικαίωμα να κληροδοτήσει κανείς την περιουσία του.

Από το 2007 κάθε δήλωση και καταγραφή ιδιοκτησίας στην περιοχή της Χιμάρας απαγορεύθηκε με κυβερνητική εγκύκλιο, η οποία εμποδίζει τη δήλωση και καταγραφή των περιουσιών των Χιμαραίων ακόμη κι αν υπάρχει δικαστική απόφαση που επιβάλει την καταγραφή.

Μεγάλες εκτάσεις που ανήκαν στην Εκκλησία ή στην τοπική κοινότητα κηρύχθηκαν ελεύθερες ιδιοκτήτη καθώς δεν είχαν δηλωθεί στο Κτηματολόγιο και ως τέτοιες πέρασαν στην κυριότητα του Ταμείου Γης για να χρησιμοποιηθούν ως αποζημίωση σε ιδιοκτήτες που έχασαν τις περιουσίες του κατά τη διάρκεια του κομουνιστικού καθεστώτος στα Τίρανα, στο Φιέρι, στο Μπεράτι και αλλού.

Η περιουσία της Ορθόδοξης Εκκλησίας και της τοπικής κοινότητας αποτελούν σημαντικά στοιχεία της κοινότητας της Χιμάρας, που είναι γνωστή για τις εθνικές και θρησκευτικές της ιδιαιτερότητες. Η στέρηση αυτής της περιουσίας υπέρ πολιτών που δεν είναι κάτοικοι της Χιμάρας δημιουργεί εντάσεις που ενδέχεται να έχουν επιπτώσεις στην εθνική και θρησκευτική σταθερότητα της περιοχής της Χιμάρας.

Την ίδια στιγμή, κατά τη διάρκεια όλης αυτής της περιόδου ιδιώτες, ομάδες ιδιωτών και νομικά πρόσωπα με πολιτική επιρροή και με κεφάλαια που σε ορισμένες περιπτώσεις προέρχονται από εγκληματική δραστηριότητα νέμονται παρανόμως γη που ανήκει σε ιδιώτες, στην Εκκλησία ή στην τοπική κοινότητα και κατόρθωσαν να δηλώσουν τις «περιουσίες» τους, ξεπερνώντας τη νομοθεσία και τα εμπόδια τα οποία οι Χιμαραίοι δεν μπορούν να προσπεράσουν ώστε να κατοχυρώσουν τις νόμιμες περιουσίες τους.

Κάθε μέρα που περνάει χιλιάδες Χιμαραίοι δεν μπορούν να κληρονομήσουν την περιουσία των γονιών τους επειδή δεν είναι δηλωμένη.

Κάτοικοι της Χιμάρας που έχτισαν σπίτια κι επιχειρήσεις στη γη τους τιμωρούνται με μαζική κατεδάφιση των σπιτιών τους από την πολεοδομία επειδή δεν μπορούν να βγάλουν άδεια ανοικοδόμησης καθώς δεν έχουν συμβόλαια για την περιουσία των προγόνων τους, για την περιουσία που ανήκει στις οικογένειές τους εδώ και αιώνες.

Η Ευρωπαϊκή Ένωση χρηματοδότησε ένα πρόγραμμα καταγραφής των ιδιοκτησιών στην περιοχή της Χιμάρας, το οποίο άρχισε το 2011 την καταγραφή υπό την επίβλεψη του Οργανισμού για την Ασφάλεια και τη Συνεργασία στην Ευρώπη. Η πρώτη φάση της καταγραφής πραγματοποιήθηκε, αλλά το πρόγραμμα δεν ολοκληρώθηκε εξαιτίας κενών στην αλβανική νομοθεσία σχετικά με το ιδιοκτησιακό καθεστώς.

Εάν πιστεύετε ότι αυτή η αδικία απέναντι στους Χιμαραίους πρέπει να σταματήσει,

εάν πιστεύετε ότι οι Χιμαραίοι πρέπει επιτέλους να ανακτήσουν το συνταγματικό τους δικαίωμα στην ιδιοκτησία, το οποίο τους το αρνούνται για περισσότερα από 50 χρόνια,

εάν πιστεύετε ότι η αλβανική Κυβέρνηση έχει την υποχρέωση να αναγνωρίσει ως νόμιμους ιδιοκτήτες της Χιμάρας, τους Χιμαραίους, οπουδήποτε κι αν αυτοί ζουν (στην Αλβανία, στην Ελλάδα, στην Αγγλία, στη Γερμανία, στις Ηνωμένες Πολιτείες κ.α.)

σεβόμενη και συμμορφούμενη στις δημοκρατικές αξίες που διέπουν το Συμβούλιο της Ευρώπης ως αντιπροσώπου των αρχών και των αξιών των ευρωπαϊκών λαών,

τότε υποστηρίξτε αυτό το ψήφισμα προς το Συμβούλιο της Ευρώπης για να δηλωθούν οι ιδιοκτησίες στη Χιμάρα στους μόνους νόμιμους δικαιούχους, τους Χιμαραίους.

The Albanian Democratic Party (DP) is calling for protests against the government on Thursday, February 20, at 1:00 pm in Skenderbeg Square.  The protestors will gather in Skenderbeg Square and will march down Blvd. Deshmoret e Kombit towards Mother Teresa Square.

Komuniteti Himariot dhe Shoqata Bregdeti, pershendesin viziten neser ne Tirane te Z/V Kryeministrit Grek E. Venizelos njekohesisht edhe kryesues I radhes I Presidences europiane , , Komuniteti Himariot dhe Shoqata Bregdeti, gjen rastin te denoncoje, veprime konkrete te qeverive shqiptare, ne te gjithe keto 23 vite te puralizmit politik, per mos kthimin e qellimshem te pronave, te popullit himariot dhe te Kishes orthodokse qe ai perfaqeson, e cila buron nga e drejta historike mijera vjecare, e pavaresise, autonomis dhe e Venomeve te Himares, si shprehje e lirive dhe te drejtave themelore te njeriut, sot ne europen e bashkuar.

Per gjithe keto vite, Shteti Shqiptar, jo vetem ka aprovuar ligje te cilat nuk kane ne themel nje process te drejte trashegimtaro legjitim, por ka mobilizuar nje opinion dashakeqas ndaj Himares, here I shprehur me ndjenja retorike, per te favorizuar mafian dhe oligarkine shqiptare, per grabitjen e pronave, me forma te ndryshme ligjore te tipit Komunist, “Prona I takon atij qe e punon”.

Greqia, si kryesuese e radhes e Bashkimit Europian, por edhe si partneri me I afert gjeostrategjik, ka pergjegjesine te ndihmoje popullin Shqiptar, per rrugen drejt europes, por njekohesisht, nuk duhet te nenvleftesoje, procesin e demokratizimit ndaj detyrave qe duhet te beje shteti shqiptar, ne raport me lirite dhe te drejtat e njeriut, ku mbi te gjitha, ceshtja e prones ne Rajonin e Himares, I ka kaluar te gjitha kufijte e tolerances.

Nisur nga ky fakt, ne verejme me shqetesim te thelle, standarte te dyfishta te qeverive shqiptare, te cilat edhe ndaj perdorimit te prones si product ekonomik dhe jetesor, per Himaren te aplikohen forma te dhunshme te konfrontimit te popullsise me shtetin dhe institucionet e tij. Aktualisht, policia e shtetit, e cila eshte e interesuar te kryej arestime spektakolare per fletevolante te shperndara ne Himare, po kryen njekohesisht operacione shkaterrimi ndaj prones private te banoreve autoktone 3000 vjet ne tokat e tyre, nderrsa paralelisht, po aprovon ligje per shqiperine, qe me qindra mijera godina, te nderetuara mbi prone te grabitur, ti legalizoje falas.

Mos regjistrimi I titujve te pronesise nga OSBE, ka bere qe qeveria shqiptare, te nxjere akte qeveritare te jashte ligjshme, per te dubluar institucionin e regjistrimit legal, duke krijuar situate tensioni dhe duke prishur pasurite e banoreve autoktone, ne emrin e zhvillimeve bashkohore.

Qeveria e meparshme ne bashkepunim me Autoritetin Vendor, miratoi Planin e Zhvillimit te Bashkise te Himares, por ky plan, duhej te vihej ne zbatim, pasi te regjistroheshin titujt e pronesise, per te cilen eshte konstatuar se 95% te banoreve autoktone,, nuk e kane, pasi nuk eshnte bere ky proces.

Zgjedhjet parlamentare, sollen qeverine e re, e cila ishte zotuar se do te kthente pronat e Himares, me nje ligj te vecante per bregdetin, por ne vend te saj, Ligji Komunist 7501, u shty per tre vite te tjera, si dhe u krijuan Agjensi Shteterore duke fuqizuar institucione policore, ne kundershtim te autoritetit vendor..

Komuniteti Himariot dhe Shoqata Bregdeti, I kerkon presidences europiane greke:
1. Qe, Brenda gjashte mujorit e kesaj presidence, qeveria shqiptare, te ndermare inisiativen ligjore dhe te permbushe detyrimet e saj kushtetuese, per ktjhimin e te gjitha aseteve tokave dhe pasurive popullit te Himares dhe bregut te detit.
2. Ti kerkoje OSBE dhe BE, te kryeje trasparence te plote, per bllokimin e procesit te regjistrimit te pronave ne bregdetin Jonian, per te cilen vete himariotet edhe njekohesisht si qytetare europiane, jane taksapagues, I ketij procesi.
3. Te bllokoje cdo tentative qe buron nga e drejta kushtetuese e komunitetit te vendose per ndarjen e re administrative, pa deshiren e tij.
4. Qeveria shqiptare, te ndale format e asimilimit dhe te pushtimit, ne emer te Ceshtjes shqiptare kombetare ndaj Himares, duke krijuar agjensi dhe institucione, qe bien ndesh me te drejten e autonomise vendore bazuar ne Konventat e Keshillit te Europes, si dhe duke favorizuar here me koncesione dhe here me projekte zhvillimi te dyshimta, grabitjen e prones nga oligarket e Tiranes.

Prona, Rama në Himarë: E zgjidhim me ardhjen në pushtet

Mar shkas, qe të bëj publike, nje tentative me permasa sa historike aq edhe korruptive, qe ka ndodhur ne Bashkinë e Himarës, në një mbledhje të Këshillit, me motivacion: "Ndarja e re e tokave bujqesore në bazë të Ligjit 7501, per banorët e Himares". Por fale votave te opozitës në këtë këshill, projekti nuk u miratua, edhe pse autoret u shprehën se ky projet, do të kalojë në mbledhjet e ardhshme. Duhet theksuar se projekti për rindarjen e tokës bujqësore, është në vazhdimin e përpjekjeve të pushtetit qëndror në Tiranë në bashkëpunim me atë lokal, për të kompletuar ndarjen e tokës me ligjin 7501, edhe per nje vit kalendarik, e cila do të ishte një dhuratë elektorale, por në vecanti një thikë pas shpine të përmasave të rezikshme në Himarë.

Komuniteti Himariot, është thellësisht i shqetësuar për zhvillimin e kësaj përmase, e projektuar në zyrat qendrore në Tiranë dhe e  praktikuar në Himarë, një bashkëveprim sa elektoral aq edhe mafioz, për të vazhduar gjidhnjë dhe pa limit, grabitjen e pasurive dhe pronave tëe Himariotëve dhe Kishes Orthodokse. Ky projekt vendim i firmosur nga kretët e Bashkisë Himarë dhe nga kryesite e pleqesive te fshatrave, i bërë publik nga inteligjeeca e Himarës në rrjetet sociale, dëshmon për një përpjekje fatale të përcarjes më të madhe historike të 100 vjetëve, brënda species së familjes himariote, ndarjen materiale dhe gjenetike për shkak të interesave politike mafioze lart dhe poshtë.

Ky projekt vendim na tregon ne, himariotët e diasporës, të mbani larg me mëndje dhe vepra Himarën, të mos mereni me pasuritë tuaja se ato tashmë do të kishin zot me okelion "Toka i takon atij që e punon" të tjerët puthuni me Milon. Kemi patur debate mes komunitetit, për qëndrimin me ligjin 7501, për të cilën kemi vendosur se Mosbindja Civile, ka qënë forma më e mirë e mos njohjes së ligjit përcarës 7501, mes familjeve himariote. Ky projekt vendim, jep vulën vendimtare të një ndarje historike mes vëllezërish të një familje, të një krahine, por që kanë histori të përbashkët glorioze. Por kjo nismë, e ka zanafillën disa vite më parë, kur tetnativat për aktivizimin dhe ligjërimin e Ligjit 7501, filluan të bëheshin realitet në pranverën e vitit 2011.

Cuditërisht Vasil Bollano, kryetari atëhershëm i Bashkisë Himarë, futi në regjistrim te procesit të pronave në Krahinën e Himarës nga OSBE, Ligjin 7501. Kryetri i Omonia, që mandatonte per here të tretë, e humbi votën për shkak se rivali i tij Jorgo Goro, e rifuti ceshjten e pronave si prioritet në politikat e tij elektorale. Por ky premtim nuk u mbajt. Dy vellezer himariot nuk shikoheshin në sy me njëri tjtetrin, jo vetëm ndaj partive politike, shkaku, prona. Himarioti që kishte në dorë formularin 6, ishte më i privilegjueshëm, ndërsa ai, i diasporës, i persekutuar, nje qytetar kritik dhe plot pasion per Himarën historike. Si mund të bëhet ndryshe, kur duan të përjashtojnë nga vendimarja, nga prona, nga e drejta për zgjedhje dhe per tu zgjedhur, nga vendlindja e gjysherve dhe baballarëve, vetëm se nuk jemi anëtarë të koperativës, për të ndarë tortën me ligjet komuniste, dhe jo sipas venomeve historike te Himarës, vendime që merren fillimisht nga disa kryepleq me nivele më të uleta të shoqërisë himariote deri në kupolën e Bashkisë?

Si eshte e mundur të mos i japin të drejtën njerëzore të kenë pronat e tyre legjitime, personalitete të disaporës himariote? Cfar mund të thuash se sduhet të kenë prona, qytetarët si George dhe William Tenet, Piro Dhima e Dimitri kutoullas, Kosma Karavella, Leonora Malo, apo trashëgimtarët e familjes Spiro Spiromilo, të artistit të madh Robert Ndrenika apo të Andon Qesarit, të Qiriako Savës apo të Aanastas Kristoforidhit, të Andrea Marko, Vasil e Petro Rucit, apo të Sotir Ninit, Roland Iliadhit, Vasil Ziut, Foto Strakoshes, Petraq Sava apo te Dhimitër Anagnostit dhe të Odise Grillos, të personave publikë, profesorët Niko Pano, Priamo Bollano, Polo Cakallit, Jorgji Hanxharit,Spiro Elina Dunit, apo të një elite gazetarësh brënda dhe jashtë vëndit? A ka kuptim Himara pa këta, të cilëve një grup pushtetarësh lokalist, u thonë qëndroni larg Himarës( ?)... Ne na mbron Ligji i republikes së Shqiperise !..........

Komuniteti Himariot, i bën thirrje, Qeverisë Rama, të cbllokojë situatën e nderlikuar për grabitjen e pronave tëe Himariotëve, duke i kërkuar në rastin precedent të këtij projekt vendim të Bashkise Himarë,që sic ka premtuar, të ndryshojë kuadrin ligjor për kthimin e pronave qytetarëve autokton Himariotë dhe jo preferencave në bazë të ligjit 7501. Ndyshimet e bëra nga qeveria Rama për Agjencinë e Zhvillimit të Bregdetit, nuk po shoqerohet me premtimin elektoral të zgjidhjes përfundimtare të cështjes së pronave në Bregdet, por i jep mundësi grabitësve që me anë të këtyre vendimeve mbështetur në ligjin 7501, të përcajnë popullin e Himarës.
